Terms of service

These terms govern your use of salvatoremotti.com (the “site”) and any purchase you make from it. By using the site or placing an order you accept them. Please read them before you buy.

1. Who we are

The site is operated by Amar Tasic, a sole trader established in Bosnia and Herzegovina, trading as Salvatore Motti, of Sarajevo 71000, Bosnia and Herzegovina, contactable at info@salvatoremotti.com. In these terms “we”, “us” and “our” mean Salvatore Motti; “you” means the person using the site or placing the order.

2. Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By ordering you confirm that the information you give us is accurate and that you are legally able to enter into a contract.

3. Products, descriptions and colour

We describe our products as accurately as we can. Product images and mockups are representations: colours vary between screens, and printed and dyed garments carry small variations between production runs. Measurements in our size guides are taken flat and have a tolerance of roughly 2 cm. These variations are normal characteristics of the product and are not defects.

All items are made to order. We do not hold stock, and stock levels shown on the site reflect our fulfilment partner ability to produce, not physical inventory.

4. Prices and payment

Prices are shown in the currency selected on the site and include VAT where applicable. Prices exclude shipping, which is calculated and shown at checkout before you pay, and exclude any import duties or taxes charged by your own country — see our Shipping policy.

We may change prices at any time, but a change never affects an order you have already placed. Payment is taken at the time of order through our payment provider; we do not receive or store your full card details.

5. How a contract is formed

Your order is an offer to buy. Our order confirmation email acknowledges receipt but does not conclude the contract. The contract between us is formed when we send you a shipping confirmation for the item concerned.

We may decline or cancel an order before shipping — for example if the item cannot be produced, if a price or description was clearly wrong, if we cannot ship to your address, or if we have reasonable grounds to suspect fraud. If we do, we refund you in full, promptly, and we tell you why.

6. Obvious pricing errors

If a product is listed at an obviously incorrect price — a decimal place in the wrong position, for instance — we are not obliged to supply it at that price. We will contact you, and you may confirm the order at the correct price or cancel it for a full refund.

7. Delivery and risk

Delivery times and costs are set out in our Shipping policy. Risk in the goods passes to you when you, or someone you have nominated, takes physical possession of them. Where you arrange your own carrier, risk passes when we hand the goods to that carrier.

8. Returns, withdrawal and faulty goods

Your right to return, your statutory right of withdrawal, and your rights where goods are faulty are set out in full in our Returns & refunds policy, which forms part of these terms. Nothing in these terms limits your statutory rights as a consumer.

9. Your account

If you create an account, keep your password confidential and tell us promptly if you believe it has been compromised. You are responsible for activity carried out under your account. We may suspend or close an account that is being used fraudulently or in breach of these terms.

10. Acceptable use

You agree not to use the site to break the law, to interfere with its operation or security, to scrape or harvest data from it by automated means, to resell our products commercially without our written agreement, or to submit content that is unlawful, defamatory, hateful or infringes someone else rights. We may remove content and withdraw access where this happens.

11. Intellectual property

The Salvatore Motti name, the SM monogram, the wings mark, our wordmarks, product designs, photography, copy and the site itself belong to us or are used by us under licence. You may not copy, reproduce, print, embroider or otherwise use them for commercial purposes without our written permission.

Buying a garment gives you the garment. It does not give you any right in the artwork printed on it.

12. Content you submit

If you send us reviews, photographs, comments or other content, you keep ownership of it and you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display it in connection with the brand, including on the site and on social media. You confirm you have the right to grant that licence. We may remove any submitted content at our discretion.

13. Third-party services and links

The site runs on Shopify and uses third-party services for payments, fulfilment, analytics and email. Links to third-party sites are provided for convenience; we do not control them and are not responsible for their content or their terms.

14. Availability of the site

We try to keep the site available and accurate, but we do not guarantee that it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it, and we may withdraw products from sale, without notice.

15. Our liability

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot lawfully be excluded — including your statutory rights as a consumer.

Subject to that, we are not liable for losses that were not reasonably foreseeable when the contract was made, or for business losses such as loss of profit, revenue or opportunity. Where we are liable, our total liability in connection with an order is limited to the amount you paid for that order.

16. Force majeure

We are not liable for delay or failure to perform caused by events outside our reasonable control, including carrier failure, industrial action, extreme weather, epidemic, war, or the failure of utilities or telecommunications networks. If such an event materially delays your order, we will tell you and you may cancel it for a full refund.

17. Changes to these terms

We may update these terms. The version in force when you place an order is the version that applies to that order. The current version is always published on this page with the date it was last updated.

18. Governing law and disputes

These terms are governed by the laws of Bosnia and Herzegovina. If you are a consumer resident in the European Union, the European Economic Area, the United Kingdom or Switzerland, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live, and you may bring proceedings in the courts of that country.

If you have a complaint, please contact us first at info@salvatoremotti.com. Most things are settled in an email or two. Note that the European Commission Online Dispute Resolution platform ceased operating on 20 July 2025 and is no longer available; consumers in the EU can instead approach their national consumer authority or an approved alternative dispute resolution body in their own country.

19. General

If any provision of these terms is found unenforceable, the rest remains in force. Our failure to enforce a right is not a waiver of it. These terms, together with our Returns & refunds policy, Shipping policy and Privacy policy, are the entire agreement between us regarding your use of the site and your purchases from it.
